1. Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of Depthlog ("Depthlog", "we", "us", "our"), including the website, the web application and the dive planning and logging tools it provides (the "Service").
By creating an account, signing in, or using the Service in any way, you confirm that you have read, understood and explicitly accepted these Terms. If you do not accept them, do not use the Service. If you use the Service on behalf of someone else, you confirm that you are authorised to accept these Terms for them.
2. What Depthlog is
Depthlog is a utility tool for recreational divers. It helps you log your dives, keep your certificates, dive sites, map and statistics in one place, and estimate planning values such as residual nitrogen time (RNT), pressure groups, no-decompression limits (NDL), equivalent air depth (EAD), maximum operating depth (MOD) and oxygen exposure.
Depthlog is provided for informational, educational and record-keeping purposes only. It is a convenience, not an authority.
3. What Depthlog is not
Depthlog is not a dive computer, is not a decompression computer, and does not run a tissue model such as Bühlmann or a gradient factor algorithm. It is not a substitute for a certified dive course, an instructor, a dive centre, a dive professional, or your own training. It is not a medical device and it does not provide medical, physiological or safety advice. It is not ground truth, and its outputs can differ from your dive computer, your training agency's tables and the real conditions of your dive.
4. Eligibility and your responsibilities
You are responsible for everything you do with the Service. In particular, you agree that you will:
- Only dive if you are certified for the dive you are planning, and only within the limits of that certification.
- Be medically fit to dive and complete any medical questionnaire truthfully.
- Always dive with a functioning dive computer and always follow it.
- Set the conservatism or gradient factors of your dive computer based on your own experience, physical condition, training and the conditions of the dive, and never beyond what you are trained to handle.
- Follow the tables, standards and regulations of your certification agency, the dive operator and local law, which always take priority over anything shown in Depthlog.
- Dive with a buddy or as required by your training and local rules.
- Inspect and maintain your equipment, and use it correctly.
- Never rely on Depthlog as your only source for planning or executing a dive.
5. Assumption of risk
Scuba diving, snorkelling and related water activities are physically demanding and involve inherent risks, including but not limited to decompression sickness, arterial gas embolism, barotrauma, panic, hyperventilation, equipment failure, adverse environmental conditions and, in the worst case, serious injury or death. Treatment for diving injuries may not be available at the dive site.
You understand these risks and you voluntarily and knowingly assume all of them. You dive at your own risk and under your own responsibility.
6. No safety, medical or professional advice
Nothing in the Service constitutes safety advice, medical advice, or professional diving instruction. The Service does not create any duty of care, supervision or professional relationship between you and Depthlog.
7. Data, tables and accuracy
The planning values in Depthlog are derived from recreational dive tables and mathematical formulas. The nitrogen reference used by the Service is the recreational air dive tables published by FIPSAS. Depthlog shows the tables and makes them available to download for reference.
Printed tables only publish a value for each listed depth. Where a depth falls between two listed depths, Depthlog interpolates linearly between them and rounds the result up to the next whole minute. For example, the table gives a no-decompression limit of 63 minutes at 18 m and 48 minutes at 21 m; Depthlog computes 53 minutes at 20 m using linear interpolation. This is an approximation that behaves closer to a dive computer than rounding up to the next table column, but it is still a table approximation and not a tissue model.
We do not warrant that the Service or its values are accurate, complete, current, or free of errors. Tables, formulas and software can contain mistakes. You must verify anything that matters against your agency tables and your dive computer.
8. Limitation of liability
To the fullest extent permitted by applicable law, Depthlog, its authors, owners, contributors and partners shall not be liable for any direct, indirect, incidental, special, consequential or punitive damages, or for any loss of life, personal injury, illness, property damage, data loss or loss of profits, arising out of or in any way connected with your access to, use of, or inability to use the Service, or your reliance on any information provided by the Service, whether or not we were advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or liabilities. Where that is the case, our liability is limited to the maximum extent permitted by law. The Service is provided "as is" and "as available", without warranties of any kind.
9. Release and discharge of responsibility
To the fullest extent permitted by law, you release, discharge and hold harmless Depthlog and its authors, owners, contributors and partners from any and all claims, demands, liabilities, losses, damages, costs and expenses, including reasonable legal fees, arising out of or related to any dive or water activity you undertake, your use of the Service, or your breach of these Terms. You agree that this release is a material condition of your use of the Service.
10. Indemnification
You agree to indemnify, defend and hold harmless Depthlog and its authors, owners, contributors and partners from any claim brought by you or by a third party arising out of your use of the Service or your violation of these Terms or of any law.
11. Your account and your content
You are responsible for keeping your account credentials secure and for all activity under your account. You retain ownership of the dive logs, certificates, photos and other content you add, and you grant us a limited licence to store, process and display that content as needed to provide the Service, including public sharing features you choose to enable. You must have the right to upload the content you add.
12. Third-party services
The Service relies on third-party providers, including authentication, hosting, database, analytics and geocoding services. They are outside our control, and we are not responsible for their acts, omissions, availability or security practices.
13. Availability and changes
We may add, change, suspend or remove features at any time, and we may update these Terms. When we make material changes we will update the date on this page. Continued use of the Service after a change means you accept the updated Terms.
14. Intellectual property
The Service, its design, code, text and branding are owned by Depthlog or its licensors and are protected by law. You may not copy, resell, reverse engineer or redistribute the Service except as allowed by law. The FIPSAS dive tables are the property of their respective owners and are shown for reference.
15. Governing law and severability
These Terms are governed by the laws applicable at the operator's principal place of business, without regard to conflict-of-law rules. If any provision of these Terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions stay in full effect.
